Terms governing your use of Visual Maker AI

1. About These Terms

These Terms of Service ("Terms") are a binding agreement between you and the operator of Visual Maker AI ("Visual Maker AI," "we," "us," or "our"). They govern your access to visualmakerai.com, our AI image and video generation tools, prompt gallery, storage, credits, and related services (collectively, the "Services").

By creating an account, purchasing credits, or using the Services, you agree to these Terms, our Privacy Policy, Refund Policy, and AI Content Use Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Services. If you use the Services for an organization, you represent that you have authority to bind that organization, and "you" includes the organization.

3. Accounts and Security

You must provide accurate information, keep it current, and protect your login credentials and API keys. You are responsible for activity under your account unless caused by our failure to use reasonable security measures. Notify us promptly at support@visualmakerai.com if you suspect unauthorized access. You may not sell, transfer, or share an account in a way that defeats account or usage limits.

4. The Services

Visual Maker AI uses third-party infrastructure and AI model providers to process prompts, reference files, and generation settings. AI systems are probabilistic. Outputs may be inaccurate, incomplete, offensive, similar to outputs provided to others, or unsuitable for your intended use. We do not guarantee that an Output is unique, factually correct, non-infringing, or eligible for copyright, trademark, patent, or other protection.

You must review every Output before publishing or relying on it. The Services are not professional legal, medical, financial, or other regulated advice, and must not be used as the sole basis for decisions that materially affect a person's rights, safety, or access to essential services.

We may add, change, limit, or discontinue features or models. Where a change materially reduces a paid Service, we will provide notice when reasonably practicable and any remedy required by applicable law.

5. Your Content and Outputs

"Input" means prompts, images, files, instructions, and other material you submit. "Output" means content generated for you by the Services. Input and Output together are "User Content."

You retain your rights in Input. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, modify, and process User Content only as needed to provide, secure, support, and improve the Services, comply with law, enforce these Terms, and follow your sharing choices. This license lasts only as long as necessary for those purposes, subject to legal retention requirements and reasonable backup cycles.

As between you and Visual Maker AI, and to the extent permitted by applicable law, we do not claim ownership of your Output and assign to you any rights we may have in it. This does not give you rights in third-party material that may appear in an Output, and it does not guarantee that any intellectual property right exists. You are responsible for obtaining permissions and assessing whether your use of Input and Output is lawful.

We do not use private User Content to train AI models operated by Visual Maker AI. User Content may be processed by the model provider selected for a generation. See our Privacy Policy for details.

6. Public Sharing

Content is private unless you choose a public or sharing feature. If you make User Content public or submit it to the prompt gallery, you grant us a worldwide, non-exclusive, royalty-free license to display, reproduce, format, distribute, and promote that content within and in connection with Visual Maker AI. You may end this license for future use by unpublishing or deleting the content, but cached copies, prior promotional materials, and copies made by other users may remain.

Do not publish personal or confidential information that you do not want others to access.

7. Acceptable Use

You must follow our AI Content Use Policy. You may not:

  • violate any law or another person's intellectual property, privacy, publicity, contractual, or other rights;
  • create sexual exploitation content, non-consensual intimate imagery, deceptive impersonation, fraud, threats, harassment, or content intended to facilitate physical harm;
  • bypass safety filters, rate limits, access controls, or technical safeguards;
  • probe, disrupt, reverse engineer, scrape, resell, or overload the Services except where applicable law expressly permits it;
  • upload malware or use automated means that interfere with normal operation; or
  • misrepresent AI-generated content as authentic when disclosure is required by law or necessary to avoid materially misleading others.

8. Credits, Prices, and Payment

Prices, included credits, model costs, currency, taxes, and any expiration date are shown at or before purchase. Paid credits are a limited, revocable right to use eligible Services. They are not money, stored value, or property; cannot be transferred or redeemed for cash; and may be used only on your account. Paid credit packages do not expire unless an expiration date is clearly shown at checkout. Promotional, free, subscription, or reward credits may have separate validity periods disclosed when granted.

Generation costs may vary by model, resolution, duration, quality, and other settings. The cost displayed before submission applies to that request. When a generation fails before a usable result is delivered, the system is designed to return the credits charged for that request. A credit return is not a cash refund.

Payments are processed by the payment provider shown at checkout. You authorize that provider to charge the selected payment method and agree to its applicable terms. You are responsible for taxes, bank charges, and accurate billing information. Our Refund Policy explains when monetary refunds or credit adjustments are available.

9. Subscriptions

If we offer a subscription, the price and billing interval will be shown at checkout. Unless stated otherwise, subscriptions renew automatically at the then-current disclosed price until canceled. You authorize recurring charges for each renewal period. You may cancel through the available billing controls or by contacting support; cancellation takes effect at the end of the current paid period unless applicable law requires otherwise. Cancellation does not by itself create a right to a prorated refund.

We will provide any advance notice of price or material subscription changes required by applicable law. If a payment fails, access or benefits may be suspended until payment is completed.

10. Our Intellectual Property

The Services, excluding User Content, are owned by us or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No rights are granted to our names, logos, software, model access, or other technology except as expressly stated.

Feedback is voluntary. You grant us a perpetual, worldwide, royalty-free right to use feedback without restriction or compensation, provided we do not identify you publicly without permission.

If you believe content on the Services infringes your rights, email support@visualmakerai.com with your contact information, identification of the protected work or right, the content and URL at issue, the basis for your claim, and a statement that your report is accurate and made in good faith. We may remove content and restrict repeat infringers where appropriate.

12. Suspension and Termination

You may stop using the Services or delete your account at any time. Account deletion may permanently remove access to User Content and unused credits, so download anything you need first.

We may restrict, suspend, or terminate access if we reasonably believe you have materially breached these Terms, created security or legal risk, failed to pay, or used the Services fraudulently or abusively. Where appropriate, we will provide notice and an opportunity to appeal. We may act immediately when needed to prevent harm, comply with law, or protect the Services or others. Remedies for unused paid Services remain subject to the Refund Policy and mandatory law.

Sections that by their nature should survive termination will survive, including payment obligations, intellectual property provisions, disclaimers, liability limits, and dispute terms.

13. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services or Outputs will be uninterrupted, secure, error-free, accurate, or suitable for a particular commercial or legal use.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, Visual Maker AI and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from the Services or these Terms.

Our total liability for all claims arising in any 12-month period will not exceed the greater of (a) the amount you paid to Visual Maker AI for the Services during that period or (b) USD 100. These limits do not apply to liability that cannot be limited by law, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.

15. Indemnity

If you use the Services on behalf of a business, you will defend and indemnify Visual Maker AI from third-party claims, damages, and reasonable costs arising from your unlawful User Content, your material breach of these Terms, or your violation of another person's rights. This section does not apply to individual consumers to the extent prohibited by applicable law.

16. Governing Law and Disputes

Before filing a formal claim, contact us and give us 30 days to try to resolve the dispute informally. These Terms do not deprive consumers of protections or the right to bring a claim in a court that cannot be waived under the laws of their place of residence. In all other cases, governing law and jurisdiction will be determined under the otherwise applicable conflict-of-law rules until the operator's legal entity and chosen forum are identified in these Terms.

17. Changes to These Terms

We may update these Terms to reflect changes in the Services, law, safety, or business practices. We will post the updated Terms and change the date above. For material changes, we will provide reasonable additional notice, such as an in-product or email notice. Changes apply prospectively. If you do not agree to a material change, you must stop using the Services before it takes effect.

18. General

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, or sale of the Services, subject to applicable law.

Translations are provided for convenience. If versions conflict, the English version controls to the extent permitted by law.
